The telecommunications industry is changing, with more and more alternative players providing communications services. Yet the industry continues to be ruled by legacy regulatory systems that focus on traditional telecommunications service providers and levy fines or impose other penalties when there is non-compliance.

Recent months have seen landmark operator penalties handed down by regulators (e.g. MTN Nigeria's €4.8 billion fine). This report examines the effectiveness of such penalties in the context of the role of regulators:

  • Does the scale of the penalty reflect the size of the operator offence?
